Invalid I-20: How International Students Can Address F-1 Status Problems

Invalid I-20: How International Students Can Address F-1 Status Problems

Form I-20 is an important document issued by a U.S. school to an F-1 international student. It is closely connected to the student’s record in the Student and Exchange Visitor Information System (SEVIS).

An expired I-20, a terminated SEVIS record or a failure to maintain a full course of study may affect a student’s F-1 status, employment authorization and ability to travel. If you discover a problem, contact your school’s international student office immediately to confirm what happened and determine whether corrective action may be available.

Does an Invalid I-20 Mean the F-1 Visa Is Invalid?

Not necessarily. An F-1 visa is primarily used to request entry into the United States. A student’s lawful status inside the country generally depends on several factors, including the Form I-20, Form I-94, SEVIS record and whether the student continues to comply with F-1 requirements.

The term “invalid I-20” may refer to several different situations:

  • The program end date on the I-20 has passed;
  • The student failed to maintain full-time enrollment;
  • A course was dropped without prior authorization;
  • The student failed to report to the school on time;
  • The student withdrew or transferred improperly;
  • The student engaged in unauthorized employment;
  • Required employment information was not reported during OPT;
  • The school or SEVIS system contains an administrative error.

Because these situations have different consequences, obtaining another I-20 does not automatically restore F-1 status.

What Should You Do If Your I-20 or SEVIS Record Is Invalid?

1. Contact Your DSO and Confirm Your SEVIS Status

The first step is to contact your Designated School Official (DSO). Ask whether your SEVIS record is Active, Completed or Terminated, and confirm the reason and date of any status change.

If the problem resulted from a school reporting error, incorrect data entry or a system issue, the DSO may be able to correct the record or submit a data-fix request to the Student and Exchange Visitor Program.

Do not leave the United States or submit an application before understanding the status of your SEVIS record and the available options.

2. Apply for F-1 Reinstatement in the United States

An eligible student may be able to apply for reinstatement without leaving the United States. The process generally begins with obtaining a new Form I-20 containing a DSO recommendation for reinstatement. The student then submits Form I-539 and supporting evidence to U.S. Citizenship and Immigration Services.

Possible application materials include:

  • A new reinstatement Form I-20;
  • Form I-539;
  • Copies of the passport, visa and Form I-94;
  • Financial documentation;
  • Enrollment verification and transcripts;
  • Copies of previously issued Forms I-20;
  • A personal statement explaining the status violation;
  • Evidence supporting the explanation.

USCIS states that applicants who have been out of status for more than five months generally must provide evidence that exceptional circumstances caused the filing delay and that they applied as promptly as possible under those circumstances.

Reinstatement is discretionary. Filing Form I-539 does not guarantee that the application will be approved.

3. Leave the United States and Re-enter With a New I-20

Depending on the circumstances, another option may be to leave the United States and request re-entry using a new Initial Form I-20 and a new SEVIS record. The student may also need to pay a new I-901 SEVIS fee and satisfy the applicable visa and admission requirements.

This option should not be treated as a simple way to “reset” F-1 status. Admission is determined at the port of entry and is never guaranteed. Beginning a new SEVIS record may also affect the student’s eligibility timeline for CPT or OPT.

Before choosing this option, discuss its academic, employment and travel consequences with the DSO or a qualified immigration attorney.

Important Precautions

Do not assume that employment, travel or a school transfer remains authorized after a SEVIS record has been terminated. ICE warns that a student who travels with a terminated record is not guaranteed readmission to the United States. The risk may be higher if the student’s F-1 visa has also expired.

Students should preserve school emails, medical documents, transcripts, tuition records and any other evidence that explains what happened. Acting quickly can make it easier to document the circumstances and evaluate possible solutions.

I-20 and F-1 Status Assessment With Junket Edu

An invalid I-20 may involve multiple issues, including the reason for SEVIS termination, the length of time involved, the student’s enrollment history and future travel plans. The appropriate solution may therefore differ from one student to another.

Junket Edu helps international students review their I-20 and SEVIS history, identify important deadlines, organize supporting documents and understand possible next steps based on their academic and immigration circumstances.

If you believe your I-20 or F-1 status may be at risk, seek an assessment as early as possible to prevent the issue from becoming more complicated.
