For F-1 international students working in the United States, the OPT expiration date is an important immigration status milestone. Many students search for “OPT renewal” because they want to extend their legal employment authorization. However, not every OPT participant is eligible for an extension.
In most cases, what students call an “OPT renewal” refers to the 24-month STEM OPT Extension available to eligible graduates in qualifying science, technology, engineering and mathematics fields.
If your degree is not STEM-designated, regular post-completion OPT generally cannot be renewed. You should plan early and consider further study, a SEVIS transfer, a change of status or another lawful option.
Do You Immediately Lose Legal Status When OPT Expires?
The expiration of OPT does not automatically mean that a student becomes unlawfully present on the same day.
If the student has properly maintained F-1 status throughout OPT and has not exceeded the applicable unemployment limit, the student will generally enter a 60-day grace period after OPT ends.
Employment is not permitted during this grace period. However, the student may use the time to prepare for departure, transfer to another SEVP-certified school, begin a new academic program or pursue an eligible change of status.
Therefore, OPT expiration should not simply be described as immediate unlawful presence.
Students who have engaged in unauthorized employment, exceeded their permitted unemployment time or had their SEVIS records terminated may not qualify for the full 60-day grace period. In these situations, students should contact their Designated School Official, or DSO, and seek an individualized assessment as soon as possible.
Who Is Eligible for a STEM OPT Extension?
To qualify for a 24-month STEM OPT Extension, a student generally must meet the following requirements:
- The student is currently in a valid period of post-completion OPT.
- The qualifying degree and CIP code appear on the DHS STEM Designated Degree Program List.
- The position is directly related to the STEM degree used for the application.
- The employer is enrolled in E-Verify.
- The student works or trains for the qualifying employer for at least 20 hours per week.
- The student and employer complete and sign Form I-983, Training Plan for STEM OPT Students.
- The application is properly submitted before the current OPT period expires.
A STEM OPT application must be based on a genuine and compliant employment and training relationship. The employer must be able to supervise the student, carry out the training plan and meet the applicable reporting obligations.
Simply providing company information or arranging a nominal employment relationship does not satisfy STEM OPT requirements.
When Should You Apply for an OPT Extension?
An eligible student may file a STEM OPT Extension application as early as 90 days before the expiration date of the current OPT. USCIS must receive the application before the existing OPT authorization expires.
The general application process includes:
- Confirm the degree title and CIP code listed on Form I-20.
- Verify the employer’s E-Verify information.
- Complete and sign Form I-983 with the employer.
- Request a STEM OPT recommendation from the school’s DSO.
- Receive an updated Form I-20 containing the STEM OPT recommendation.
- Submit Form I-765 to USCIS within the required period following the DSO recommendation.
- Keep the Form I-797 receipt notice and monitor the application status.
The filing date is not the date on which the student begins preparing the documents. Students should leave enough time to review Form I-983, signatures, E-Verify information and Form I-20 dates before submission.
Can You Continue Working While the STEM OPT Application Is Pending?
If an eligible student timely files a properly completed STEM OPT Extension application before the current OPT expires, employment authorization is generally automatically extended for up to 180 days while the application remains pending.
The extension may end earlier if USCIS denies the application.
Students should retain their expired Employment Authorization Document, USCIS receipt notice and updated Form I-20 with the STEM OPT recommendation. They should also coordinate with their employer regarding Form I-9 reverification requirements.
A student cannot continue working merely because an extension application is being prepared. The application must be filed on time and meet the applicable requirements.
What Can Non-STEM Students Do When OPT Expires?
Students with non-STEM degrees are generally not eligible for the 24-month STEM OPT Extension. Depending on their individual circumstances, they may consider:
- Applying to a new academic program and completing a SEVIS transfer;
- Having an eligible employer file an H-1B petition;
- Determining whether the Cap-Gap extension applies;
- Applying for another appropriate nonimmigrant status; or
- Making departure arrangements during the grace period.
Each option has different academic, employer, timing and immigration requirements. Students should begin planning before their EAD expires instead of waiting until the end of OPT.
